So it should be presented as images with captions (or even plain paragraph text) following one another. Template #15 Deleted Account	Issue #7 Apr 5, 2019	Deleted Account ✅ در موارد زیر زن میتواند در خواست طلاق کند : 1- در صورت استنکاف شوهر از پرداخت نفقه و عدم امکان اجبار او به پرداخت و نیز در صورت ناتوانی شوهر از دادن نفقه 2- در صورتی که دوام زوجیت موجب عسر و حرج زوجه باشد . عسر و حرج به معنای دشواری ، سختی و تنگناست ، یعنی ادامة زندگی مشترک برای زن مشقت بار است . باید افزود که اثبات عسر و حرج به دلیل نبودن رویة واحد در دادگاه ها کار چندان ساده ای نیست . 3- در صورتی که شوهر 4 سال تمام مفقود الاثر شود و حکم موت فرضی ( که تشریفات خاص خود را دارد ) در مورد او صادر شده باشد. در این مورد در صورتی که مرد پس از صدور حکم طلاق و پیش از تمام شدن ایام عده ، پیدایش شود می تواند رجوع کند و بدین ترتیب حکم طلاق فاقد اعتبار خواهد بود . 4- در خواست صدور حکم با استفاده از ماده 1119 قانون مدنی ؛ به موجب مادة یاد شده (( طرفین عقد می توانند هر شرطی را که مخالف با مقتضای عقد مزبور نباشد ، در ضمن عقد ازدواج یا عقد لازم دیگر ‌[ عقدی که با ارادة یک طرف قابل انحلال نیست ] بنمایند . مثل اینکه شرط شود هر گاه شوهر زن دیگر بگیرد یا در مدت معینی غایب شود یا ترک انفاق نماید یا بر علیه حیات زن سوء قصد کند یا سو ء رفتاری کند که زندگانی آن ها با یکدیگر غیر قابل تحمل شود ، زن وکیل و وکیل در توکیل باشد که پس از اثبات تحقق شرط در محکمه و صدور حکم نهایی خود را مطلقه سازد . )) بنا براین زن می تواند با گنجانیدن شروط ضمن عقد و اخذ وکالت و وکالت در توکیل امکان درخواست طلاق را علاوه بر موارد سه گانة بالا برای خود فراهم سازد . این شروط که در پایان اسناد ازدواج فعلی درج شده اند بایستی به امضای زوج و زوجه رسیده باشند . سقاییان Declined by admin
