Sorry, but I can't agree with you. Checklist says just the opposite: "
The cover must not be set if:
The cover image is duplicated in the article."
In the case you mentioned the images are not identical (which obviously means that they are different) and they don't play the same role: one of them could not be interpreted as the cover since it appears several paragraphs deep in the article. In the current case we have two images which obviously play the same role of a cover.
