I think its authors/developers mistake. Yes, we can combine <div class="gallery"> + next-sibling <div class="gallery">, but it's not correct. Imagine, that authors will place two DIFFERENT galleries together without text between them. What then?

We need to look at the code logic, not to fix developers mistakes. Everything may be happen.
