Why is the first image (without captions) of the gallery used as a cover?

- I use the preview image of the gallery as a cover not the first one.
For example:

The gallery preview image comes as the second image in the gallery.
and some pages don't have the gallery preview image inside the gallery like this one:
https://www.gmx.at/magazine/unterhaltung/kino/kinostart-dumbo-schoensten-disney-klassiker-33627354
Ok, now what about the rule saying "Cover image must not be used if its duplicated in the article"
The problem is that the gallery preview image has different @src attribute,
different than the same image that is included in the gallery. Which makes it un-identifiable.
Sometimes they look partially same, like preview image with a text on it while the same image inside the gallery doesn't have that text or two images from the gallery merged like:
